If you have just found out about some traffic (including certain littering and waste offences) or tolling fines within the last 14 days, you may be eligible for an infringement extension.

You must make your application within 14 days of becoming aware of your fines. By law your application must include a correctly completed statutory declaration or affidavit. If this is not provided your application cannot be processed.

Infringement extension

If granted, an infringement extension gives you an additional 28 days to deal with your fines with the options available at infringement stage. This means you can:

• nominate the responsible driver
• submit a request to have the matter heard in court, or
• apply for an internal review.

• What fines are eligible?

  You can only apply for an infringement extension with Fines Victoria for:

  • tolling offences
  • traffic related offences (excluding parking, excessive speed and drink or drug-driving offences)
  • littering or waste offences that occurred in relation to a vehicle.

  If your fine is for a conviction related offence like excessive speeding and drink or drug-driving, you still need to apply for an infringement extension through the Magistrates’ Court. Visit the Magistrates’ Court website for information on how to apply with the court.

• What fines are not eligible?

  If you were handed the fines at the time of the offences or have known about them for more than 14 days, you are not eligible for an infringement extension.

  Court issued fines, civil and some criminal warrants are also not eligible for an infringement extension.

• Who can apply?

  You can apply for an infringement extension if you are:

  • the person named on the fine
  • an authorised representative of the company named on the fine
  • a person with the authority to act on behalf of the person or company named on the fine (for example, their legal representative).

• What do I need to include in my application?

  By law, your application must include a statutory declaration or affidavit signed in front of an authorised witness or authorised affidavit taker which states:

  • the fines listed in the application were not handed to you in person, and
  • you only became aware of the fines within the last 14 days.

  Your application will not be processed if you don’t provide a correctly completed statutory declaration or affidavit.The person or authorised representative of the company named on the fine must sign the statutory declaration or authorised affidavit taker. It can’t be signed by your third-party representative.

  Authorised witnesses for statutory declarations include a pharmacist, a medical practitioner, school principal or someone who works for Australia Post, the Australian Public Service or the Victorian Public Service and has for more than 5 years.   You should also provide supporting documents or information which explains why you didn’t know about your fines. This might include copies of your passport showing you were overseas or VicRoads records showing you moved house.

  If your fines were issued by Victoria Police, you should also include completed application forms for the next step you want to take if your application is granted. For example, if you want to nominate the responsible person, include a completed nomination statement with the application.

• How can I submit my application?

  You need to submit a written application and a correctly completed statutory declaration or affidavit within 14 days of becoming aware of your fines. If your application does not include a statutory declaration or affidavit it cannot be processed.

  The easiest way to do this is by using the online webform and attaching your supporting documents to the application.

  If you can’t submit the application using the webform, you can download the infringement extension PDF application form and submit the completed form and your supporting documents via an online enquiry. Select ‘Upload a completed form …’ and choose the option ‘Infringement extension’.

• What happens after I apply?

  Once we receive your completed application, we will place the fines included in your application on hold.

  If any of the fines in your application are the subject of an enforcement action like a driver and vehicle sanction, these fines will not be placed on hold and the enforcement action will stay in place. If your application is granted, you need to deal with your fines (such as nominating the responsible driver) before the enforcement action can be lifted.

  When we review your application, we will be checking our records to see whether you knew about your fines more than 14 days before you made the application. This means, we will check to see if you have previously applied for a review of the fines, attempted to deal with them, contacted us about them or were handed the fines in person.

  We will notify you of the outcome of your application by post.

• What happens if my application is granted?

  If your application is granted, you have 28 days to deal with your fines by:

  • nominating the responsible driver at the time of the offence
  • applying for a review with the agency that issued the fine
  • requesting to have the matter heard in court
  • applying for a payment arrangement with Fines Victoria or a payment plan with the agency that issued the fine
  • paying the fine.

  If you haven’t already done so, you need to send your application to us for what you want to do next for fines issued by Victoria Police or one of the agencies listed on About infringements.

  You should do this quickly as you only have 28 days to deal with the fines after your application is granted.

  Visit Find a form, download, and complete the form for the action you want to take. For example, download and complete the nomination statement with the details of the responsible driver at the time of the offence if you want to nominate the fine.

  You can submit the completed forms via an online enquiry. Select ‘Upload a completed form …’ and choose the option ‘Infringement extension’.

  If your fines were issued for a litter or waste offence, you need to contact the agency which issued the fines to:

  • pay the outstanding amount
  • set up a payment plan, or
  • submit an application for what you want to do next.

  If any of the fines in your application are the subject of an enforcement action like a driver and vehicle sanction, the enforcement action will stay in place until you deal with your fines (for example the nomination statement you submitted is accepted by the issuing agency).

  Make sure you take action to deal with your fines within 28 days of your infringement extension application being granted. If you don’t the fines will progress, and further enforcement action may be taken against you.

• What happens if my application is refused?

  If your infringement extension application is refused, enforcement action will continue for any fines included in the application until you take action to deal with the fines.

  The options available for dealing with your fines will be listed in the outcome letter you receive via post.
