Falsely nominating someone as the driver is against the law

You must tell the truth when nominating a driver. 

It is against the law to say someone was driving the vehicle when an offence happened if they weren’t driving. It is also an offence to let someone nominate you as the driver, if you weren’t driving the vehicle, even if it is a friend or family member that is asking.   

If you give false information when nominating a driver, you can be fined more than $10,000 and have your driver licence suspended. The fine for a company that gives false information is more than $18,000. 

We have systems and checks in place to spot false nominations, and we refer them to Victoria Police for investigation. Victoria Police can decide to charge you with other offences or take you to court which can lead to you being sent to jail. 

The Road Safety Act 1986 has more information about the offence of providing false or misleading information in a nomination statement for a traffic fine.
