When you should nominate

• Are you an individual? Open / Close

  You should apply to nominate if:

  • someone else was the driver responsible for the vehicle at the time of the offence
  • you sold the vehicle to someone else or disposed of the vehicle before the offence date
  • you believe the vehicle or number plates displayed on the vehicle were stolen
  • you were incorrectly nominated as the responsible person.

  If your fine is for an excessive speed offence, you’ll need to complete and send your application within 28 days of your Infringement Notice issue date, before your licence is automatically suspended.

  You cannot nominate another driver if:

  • you were issued with an on-the-spot fine at the time of the offence
  • your fine is for a drink or drug-driving offence
  • your vehicle was unregistered at the time of the offence.

  Your nomination may not be accepted if you can’t properly identify the person responsible.

  Is your fine at the Notice of Final Demand or Enforcement Warrant stage?

  At this stage of the fines lifecycle you cannot nominate another driver.  Please see the request a review section for information on the grounds available for enforcement review.

  Note: It’s an offence to knowingly provide false or misleading information in a nomination application. Individuals can be fined more than $9,000 and lose their licence.

• Are you a company? Open / Close

  When you receive a fine for a company vehicle, you must nominate the driver responsible for the offence.

  You can also submit a nomination if:

  • another company or individual was in possession of the vehicle at the time of the offence
  • the company vehicle was sold or permanently disposed of before the offence date
  • you believe the vehicle or number plates were stolen
  • the company was nominated for the fine by mistake.

  If the nomination application is accepted, the fine will be reissued to the driver responsible. The fine payable by the individual will be significantly lower than the fine owing on the company Infringement Notice.

  If you don’t nominate the responsible driver:

  • you’ll remain liable for the fine
  • after 3 or more offences in 12 months, you may be fined more than $18,000. This applies whether the fines are paid or not.

  Not knowing who was driving the vehicle at the time of the offence is not a reasonable excuse.

  You cannot nominate another driver once a fine is registered with the Director, Fines Victoria. Please see the request a review section for information on the grounds available for enforcement review.

   

• What happens after you apply? Open / Close

  You’ll get a notification of the outcome. If your nomination application is accepted, your fine will be withdrawn and reissued to the person you’ve nominated.

  The person you nominate can reject the nomination. If this happens, the fine will be reissued to you.

  
  
• Don’t want to apply online? Open / Close 

  You can no longer apply to nominate when your fine has reached Notice of Final Demand stage.
